They shouldn't be. Enemies that are in the "stunned" action now get unregistered as threats. However if they don't react to compliance yells after a while they will shoot them...
I personally have never experienced this issue. As soon as they get stunned the officers seem to just ignore them until the end of the action. Which sucks because suspects...
