Will we get Spotpass access anytime soon?

Pretendo, the recreation of Nintendo game servers could support it, although, I doubt it, since the emulator would need Nintendo Network support, nor is it known if Pretendo is working on that feature. But since it would require to send from Official game servers, I don't think so.
