Microsoft patents

Hello, As far as I know, Microsoft has filled several patents based on Bw-Tree research papers. My question is why the usage of OpentBWTree does not break those patents or in other words how OpenBWTree differs from BWTree in that it can be open-sourced without breaking filled in patents?
