This is indeed happening, but this has nothing to do with the merge script — adjust your subtitle styles so that the text fits in its designated position. See the specs https://www.matroska.org/technical/specs/subtitles/ssa.html

offtopic: here is a python version of the SRT merge script (depends on the srt module that needs to be installed with pip3 install srt) — it does not involve complicated ASS formatting; basic colors and formatting can be done with SRT alone.

Years ago I've developed a tools similar to 2srt2ass here (cause I didn't know this one). To solve this issue I simply added a margin to the top subtitle (code is here). On my experience It is working fine on VLC at least.
