Orion with V2.2: Ability not working?

The ability of Orion to buy at face value from the Foreign Investor does not seem to reliably trigger. If another corporation offers for the FI's company then Orion is offered a chance to move in, but if Orion has to offer first then it seems not to be able to buy at less than the full asking price.
