sometimes maximizies the command buffer

i have :MaximizerToggle! bound to m in normal mode, so whenever i have to maximize a split, i just press m and it maximizes. but sometimes the command buffer maximizes to the top. this is quite annoying and happens quite often. then i have to use the mouse to drag the status line down.
