Evaluating impact of the new TOB process

Hello,

Latest news from the Minfin Cpic Taxdiv as I sent my last declaration on 11th July (on purpose, so I get their latest message) was an updated instruction for future declarations:

Modification des modalités de dépôt des déclarations en matière de taxes diverses - Mise à jour 
À partir du lundi 14 juillet 2025, vous ne pourrez plus envoyer par e-mail vos déclarations en matière de taxes diverses. 
À compter de cette date, nous vous invitons à introduire vos déclarations en matière de taxes diverses via notre nouvelle application en ligne sécurisée, DIVTAX, accessible dans **MyMinfin > Ma déclaration > Taxes diverses > Suivant**.

Privilégier MyMinfin, c’est opter pour la facilité. Toutefois, si vous ne pouvez pas utiliser l’application en ligne ou si vous préférez une autre méthode, vous pouvez toujours remplir le formulaire papier et l’envoyer par courrier postal à l’adresse suivante :

From my understanding it means you can send the information in one of two ways in MyMinFin:

  • Either send the PDF as attachment in a message to box 707. In MyMinFin in French you'd do that using Mes interactions > Soumettre un document ou répondre à un courrier > J'utilise le code à trois chiffres qui est mentionné sur le courrier que j'ai reçu > "707" > Je le fais > En mon Nom > Suivant and attach the PDF
  • Or in "Ma déclaration" there is a new "Taxes diverses" box which sends you to the new DivTax Service

I don't need to submit a declaration right now but it looks like it's a web form in which you put the values instead of the PDF.

To be investigated how / if TOBCalc can help with that (or just a "put this from the PDF in that field of the form" etc). Documentation for the DivTax service is available here: https://finances.belgium.be/fr/E-services/divtax

I just had a look at the web form. It seems like in step 3 you still have to submit a PDF. I wonder if that is supposed to be the TOB declaration PDF? Although that seems silly if you just had to enter all those values in the previous step.

Either way, it ironically still seems faster to download the PDF through tobcalc and submit it through "My interactions" than to copy/paste all the values into the form fields through DivTax.

It may be because SPF Finances does not advertise the My Interactions functionality as a way to communicate unless they contacted you in the first place. However as I have some specific tax forms (because of France Tax) to fill in that I noticed instead of sending by physical mail, you could use My Interactions with the correct "box" code and that it would route to the right department in the same way as if they received a scan from a physical mail.

Let's check the documentation to see what is needed at this stage or if attachment is optional for TOB...

On the screenshot that I posted, it is actually possible to click through to the next page without submitting any attachments. So I doubt the PDF needs to be attached.

Then I guess the last thing that would be nice to figure out is whether we're supposed to use the "My interactions" functionality without being contacted first. Because that remains the most efficient option since you don't have to fill in all the form boxes.

So the updated docs here in French states (summary):

  • E-mail is no longer supported
  • Submission via "DivTax" is the preferred way
  • Submission by physical mail is the back plan - and here is the PDF if you declare in paper format

Which would tend to indicate that the PDF is not required in case of DivTax submission. I don't think they will officially say they support or not My Interactions because today it's treated the same for them as physical mail.

Regarding the month to be filled in DivTax (as you have the right to submit for 2 months when you are the principal), it's not formally written but their example states (translation by Copilot)

For example, the instructing party who concludes transactions subject to the TOB during the months of July and August may include in their declaration, which must be submitted by the last working day of September, not only the transactions concluded in July but also those concluded in August. In other words, they have the option to include in their declaration the transactions concluded during the two preceding months (Art. 125, CDTD).

Which would tend to indicate that you can still do one declaration every two months (instead of having to do 12 of them) and declare the oldest of the two months as the period.

⚠️I found they updated page 3 of the TOB form link to latest version. Nothing to be customized by the submitter anyways, but the instructions are updated (tax account number, mailing address if physical submission).
