Still unable to repro using blender 3.5 beta, looks like a blender's macOs build related issue.
You must enable "OpenGl" backend in preferences -> system instead of "Metal" one. see https://projects.blender.org/blender/blender/issues/106304
You should be able to set a new constraint at any time (start point of measurement) using C
CAD Transform rely on blender's api scene ray cast for snap to mesh. Would call collection instances not visible to ray cast when source collection is hidden a blender bug....
Basically when you setup reference axis using a single point z axis (default rotation axis) will point up, y axis will be perpendicular to z axis and lie on xy...
Use "E" in order to setup your Z axis using an edge snap at once, then snap to "from" and "to" should rotate your model the way you like.
