Splitting tabs unpins tabs

When I split the window from a pinned tab, any tab to the left is kept and remains pinned, however, all the tabs to the right become unpinned (see screenshot)

I'm not a fan of the opening of new tabs, is there a way to turn the new tab function off, and incorporate the tabs on the left?

@laced66 if you uncheck "empty tab" option the no new tab will be created. Only existing tabs will be moved around. It works by looking at the current tab and tabs to the left of the selected tab. The extension does not look to the left. This is similar to how chrome works if you right click on a tab.

Maybe you could make that default, it seems to make more sense to me. But it's a bit annoying that tabs on the left of the active tab can't be used.
