Publish widget breaks when publishing initial draft with errors

Hi,

There is a bug with the publishing widget when working with initial drafts in workflows. When you have an initial draft that is in a workflow and you set its fields so that it fails validation and then try to publish it, the page returns with validation errors but the publish widget loses its workflow tab. Refreshing the page brings it back.
