Usability: disabled login button in floating footer

When I first load the site, the disabled "Login in" and "Create account" buttons are floating at the bottom on the window, with no indication of how to enable them.

I think we want a pattern like a EULA: Maybe get rid of the floating footer? or move the checkbox into it? Or move the-stuff-they're-supposed-to-read-but-probably-won't into an iframe?
