Is 'E36: not enough room' avoidable?

I have set a minimum width and I occasionally get E36: not enough room trying to open a split. I guess this is expected behaviour but do you know is it possible to force the window to open in these cases albeit with a width smaller than the min. I just like having the minimum width determine the general size of unfocused windows.
