Needs to be tested, and probably expanded to cover other common filenames for font files.

what if the theme author created the font? Is that a realistic scenario or do theme developers always just rip off fonts from somewhere else?

I would say it's rather unlikely that fonts added to a repository should be there, and on occasions when they are it would be discussed during the application process.
