Conflict seen between EULA and Apache License
ST is asking to clarify the need for the EULA file in addition to the LICENSE file (Apache-2.0) and which one prevails.
We would need ultimately to get confirmation from Infineon that all files under https://github.com/Infineon/abstraction-rtos are indeed licensed under Apache-2.0.
Hi @GFASTM ,
The libraries are licensed according to the standard Cypress EULA. That document “carves out” open source code as being controlled according to its usual license. This allows us to a) ship assets comprising only open source code and b) mix proprietary and open-source code in the same asset. The Apache license requires a file called LICENSE.txt to be present. Note that the header in the source file identifies the license for that file.
Here is section 3 of the EULA, which states “Third Party Software is subject to the applicable license agreement and not this Agreement.“.
- Free and Open Source Software. Portions of the Software may be licensed under free and/or open source licenses such as the GNU General Public License or other licenses from third parties ("Third Party Software"). Third Party Software is subject to the applicable license agreement and not this Agreement. If you are entitled to receive the source code from Cypress for any Third Party Software included with the Software, either the source code will be included with the Software or you may obtain the source code at no charge from http://www.cypress.com/go/opensource. The applicable license terms will accompany each source code package. To review the license terms applicable to any Third Party Software for which Cypress is not required to provide you with source code, please see the Software's installation directory on your computer.
Warm Regards Alen
