Prop 36 on November 2024 ballot

Overview

Prop 36 is on the 2024 ballot. Its aim is to change portions of Prop 47.

The goal of this issue: for UXR team to keep tabs on these efforts and how they play out in the November 2024 election.

Prop 47, which passed in 2014, was aimed at reducing California's prison population, and contained provisions for reclassification and resentencing. Certain non-serious, non-sexual, non-violent felony convictions (simple drug possession, petty theft, shoplifting, forgery < $950 in value) could be reclassified as misdemeanors if certain conditions were met. Those in prison for these offenses could request resentencing and release.

The 2024 fall ballot initiative, Drug and Theft Crime Penalties and Treatment-Mandated Felonies Initiative, is trying to undo some of the provisions of Prop 47 including instituting tougher penalties for retail theft and drug possession.
