Can I safely use it to unlock achievements without getting a Ban/Restriction?

Steam is no running

Turn off whatever you're using to fake game ownership in Steam. You cannot edit achievements on Steam for games that you do not own.

Does this get flagged on BattleEye?

I have no idea. There's no realistic reason to be running SAM while running a game that uses BattlEye however. If you mean using SAM for a BattlEye protected game,...
