Finder "copy file" progress bar not floating

I copied a file from a dmg (was installing a new version of OmniGraffle), and the progress bar window was not considered as floating.

Is it a floating window though?

I may have to devise some sort of scheme to figure out if a window is a utility window or not, (Might be sufficient to just specify a minimum window size to observe)

It may not be a floating window, but as its size is fixed, it's a bit strange to see it with a bunch of empty space around it.
