3ds Max 5 fail to find d3d device

As odd of a program to test with this, I have 3ds max 5 as part of a toolchain for a game I'm modding. It runs well on windows, but only in opengl. The direct3d 9 mode fails to run, so I was hoping to use dxvk to force it. However, instead of just failing to start, dxvk causes 3ds max 5 to be unable to find a hardware device, and forces you to return to opengl. I understand if this is out of scope, but d3d is much more efficient, and would make workflow a lot easier. OpenGl's renderer crashes A LOT in windows 10.
