This issue was still happening with a client site of mine. CE1.7.0.2, SPC0.8.2. I've come up with a patch fix by overloading Mage_Checkout_CartController::updateItemOptionsAction(). You can find this patch here: https://github.com/dfelton/FirstScribe_SimpleConfigurableProducts
