[Red Faction, Max Payne, Max Payne 2] NVIDIA Control Panel Max Frame Rate setting does not work

Hi there. I am running into an issue where setting the max frame rate of certain games in the NVIDIA Control Panel has no effect. So far I've encountered this behavior in Red Faction, Max Payne, and Max Payne 2. Vsync works just fine however. Is this something that is fixable in d3d8to9?
