I have a legal question. Condition 17 on Indemnity puts a responsibility on the contractor. If the solution is supplied with an MIT License that has an "as-is " clause with no indemnity. Has this terms conflict been resolved by the Commercial Arbitration Act (Canada) (section 18) previously?

It seems that asking for indemnification on Open Source delivered solution would require the contractor stay insured for a potentially long time after delivery.
