RuTorrent installed: 3.10 -> RuTorrent available: 4.0 but rtinst dont install updated version?

On Ubuntu server: Distributor ID: Ubuntu Description: Ubuntu 20.04.4 LTS Release: 20.04 Codename: focal

When I run rtversion , I get this info:

rtorrent installed: 0.9.8 rtorrent available:

RuTorrent installed: 3.10 RuTorrent available: 4.0

rtinst fatal: unsafe repository ('/etc/rtinst' is owned by someone else) To add an exception for this directory, call:

    git config --global --add safe.directory /etc/rtinst

Current Release: rtinst /usr/local/bin/rtversion: line 46: [: =: unary operator expected

Choose which build to install, (if you are not sure select 1)

  1. Use the latest stable release
  2. Use the most recent master build Select 1 or 2: 1 rutorrent_old has been deleted

Installing version 4.0 of rutorrent Your existing rutorrent folder will be moved to /root/rutorrent_old

If you are not happy with the upgrade you can restore the old version, by rerunning this script

Installing Rutorrent (v3.10) Setting permissions, Starting services

Installation of RuTorrent complete

Its telling me its install version 4.0 but further down its says v.3.10 ?

version 3.10 is the best version for this script anyways, any higher things start to break
