trademark registration against trolling and malware?

Open source project are difficult to protect from trolls and malware bundlers. What can we do against a website spreading Tribler bundled with spyware and malware? We don't wat to act like The Internet Police! What should we do?

This is not a far fetched scenario, it happens a lot:

One route is to register the trademark "Tribler". Then we need to pay lawyer to enforce people that spread malicious software using our open source project name.. :-( No US trademark exists, but similar projects exist: info: http://fossmarks.org/
