game lags after going to home menu

HW version, New 3DS running at old 3ds clock/L2 off, Luma 10.3 (Nutez edition) When you are in a stage, open home menu with home button, and then go back in the game, the game stutters and runs slowly. Overclocking the 3ds to new 3ds clock doesn't speed it up
