Gesture navigation fails to activate without tapping the screen first

Steps to reproduce

Try to use back gesture (swipe from side of screen) without tapping on the screen

Expected behavior

The back gesture works correctly

Actual behavior

Fails to activate

Probably Android 14 beta issues UPDATE: can confirm gestures only fail to work when the screen is not brought into focus. (ie: bring up the navigation menu)
