I came across this because i also find it impossible to tell whether the tab i am currently using is "incognito".
When you say "lego" you probably really mean "logo" or better "icon"?
I do not think it has anything to do with the location of the address-bar or search-bar, mine is up top.
Opening the very same website in a regular tab and in an incognito tab it seems one can not really tell which is which while just browsing it. Opening the incognito makes the "close all incognito tabs" notification icon appear, but in the browser itself the tabs look identical. You have to navigate to the tabs view (rectangle with num inside, between plus and dots, right of url).
It would be nice if the color would differ or the incognito logo would actually be somewhere visible.
I really like the default incognito browsing, but sometimes its weird when i actually want to visit a site where cookies matter. i.e. accidentially visit my bank incognito and having to 2FA, or reading the news and wondering why i can not read paid articles while having a subscription. When i open a new browser with no tabs open, then use the search-tabs-bar to visit any given website ... its incognito by default, where i should have gone the "+" route for the bank or news.
