Anne has not replied yet. Request has been brought up to Anne during WP2/3 call July 10th.

sections from WP6 deliverables around sharing data: The relationships and responsibilities sharing between the data controller and the processor shall be detailed in a contract or another binding legal act. This contract shall set out the subject-matter and duration of the processing, the nature and purpose of the processing, the type of personal data and categories of data subjects and the obligations and rights of the controller and comply with Article 28(3) of the GDPR.

Controls for obtaining consent:

  • Express consent prior to sharing data with other users
  • Explicit consent prior to sharing data for fairification

Data reuse: Assure that no restrictions (e.g. IP) contradictory to FAIRplus objectives/licenses affect the data that will be shared through an open database

If personal data are at stake, the data controller of the IMI project in question is a key person; it is also necessary that FAIRplus designates a data controller for FAIRplus itself. Some responsibilities may be shared (joint data control) or FAIRplus may act as a “subcontractor” for some data management steps (e.g. FAIRplus may have the responsibility of some steps like pseudonymisation); in addition, FAIRplus has the responsibility of managing the data lawfully, including personal data during the steps of the project (FAIRification).
