Privacy enhancements fails when using berlinFork

Actual behaviour

When sending a transaction using privacy enhancements and when the network has the berlin fork enabled updating the contract state fails. There is an error when checking state that doesn't take into account berlin fork changes specifically around sstore and access lists.
