Update termsOfUse in context and remove note about bug

This is a follow up issue to address the changes that were discussed in #776 and temporarily noted in #787, but deferred until they could be properly addressed in V2.

The following needs to be done to address this issue.

  1. remove the note added in #787
  2. update the V2 context to include the termsOfUse term
